Welcome to beGalileo! We are excited to have you as part of our learning community. By accessing or using our services, you agree to comply with and be bound by these Terms of Use. Please read them carefully. If you do not agree to these Terms, please refrain from using our website or services.
1. Introduction
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "You") and CarveNiche Technologies Private Limited ("Company," "We," "Us"), governing your access to and use of our website www.begalileo.com ("Site") and related services.
By accessing our Site or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any related policies, including our Privacy Policy.
We reserve the right to update or modify these Terms at any time. Your continued use of the Site after any updates constitutes acceptance of the revised Terms.
2. Purpose of the Website
2.1 The Website is designed to provide information about the Company, its services, and associated programs, including but not limited to the beGalileo Learning Program.
2.2 The Website facilitates the services provided by the Company and allows registration for students, parents, and guardians seeking to enroll in the beGalileo Learning Program.
2.3 Users may create an account on the Website for access to learning resources, class bookings, and additional services provided by the Company.
2.4 The Website serves as a platform for educational engagement, including live classes, self-paced learning, assessments, and interactive content.
2.5 The Website also provides access to customer support, academic assistance, and relevant notifications for enrolled students and parents.
3. Intellectual Property Rights
3.1 All content on the Website, including but not limited to text, images, videos, software, trademarks, service marks, and logos, is the exclusive property of CarveNiche Technologies Private Limited or its licensors.
3.2 You are granted a limited, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes. Any unauthorized reproduction, modification, or distribution of the Website’s content is strictly prohibited.
3.3 You may not use beGalileo’s trademarks, trade names, or service marks without prior written consent.
3.4 The Company reserves all rights not expressly granted in these Terms.
4. Data Privacy and Protection
4.1 The Company values and protects user privacy in compliance with applicable data protection laws.
4.2 All personal data collected through the Website is handled in accordance with the Privacy Policy.
4.3 By using the Website, you consent to the collection, processing, storage, and use of your data for educational and operational purposes.
4.4 Users must ensure that any information provided is accurate, and they retain the right to request corrections or deletions of their data.
4.5 The Company will not share, sell, or distribute personal data to third parties without user consent, except as required by law or necessary for service provision.
4.6 Users agree not to misuse or exploit the personal data of others obtained through the Website.
5. Use of the Website
5.1 Your access to the Website is at the sole discretion of the Company.
5.2 You may use the Website for obtaining information, registering, enrolling, or participating in the beGalileo Learning Program.
5.3 The Company reserves the right to restrict, suspend, or terminate your access to the Website if it determines any violation of these Terms, including but not limited to improper use of the Website.
5.4 The use of the Website is also governed by the Company’s Privacy Policy and any other applicable policies, which you agree to comply with upon accessing the Website.
5.5 You agree not to:
- Use automated tools (such as bots) to access or scrape Website content.
- Upload, share, or distribute content that is harmful, defamatory, or infringes on intellectual property rights.
- Misuse the Website for commercial, illegal, or disruptive activities.
6. Account Responsibilities
6.1 You are responsible for maintaining the confidentiality of your username and password and all activities that occur under your account.
6.2 You must notify the Company immediately of any unauthorized use of your account.
6.3 The Company shall not be liable for any loss resulting from unauthorized account access.
6.4 You may not transfer, sell, or assign your account to another person.
6.5 Account Password and Security: Upon completing the registration process, you will receive a password and account designation. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
- (a) Notify the Company immediately of any unauthorized use of your password or account or any other security breach.
- (b) Ensure that you exit from your account at the end of each session.
The Company shall not be liable for any unauthorized access to your account or data resulting from your failure to safeguard your credentials.

7. Payment Policy
7.1 The Company accepts payments through multiple payment gateways, including but not limited to PayPal, Stripe, and Razorpay.
7.2 Users may pay using credit cards, debit cards, or other payment methods supported by the chosen gateway.
7.3 Payments made outside India are processed in USD ($) or the applicable local currency, as per the payment gateway settings and the user's location.
7.4 The Company is not responsible for any additional transaction fees charged by banks or payment service providers.In case of payment failures, users are advised to retry the transaction or contact their payment provider for further assistance.
7.5 Billing and Automatic Renewals: Certain beGalileo subscriptions are set to auto-renew. By enrolling in an auto-renewal subscription, you expressly authorize the Company to charge your payment method at the beginning of each renewal term (monthly, quarterly, or yearly) at the then-current subscription rate.
7.6 Your subscription will automatically renew on the same billing date as the initial subscription date unless canceled before the renewal date. Users may cancel their auto-renewal at any time by adjusting their subscription settings in their account.
7.7 The amount billed may vary due to promotional offers, changes in subscription plans, or applicable taxes, and users authorize the Company to charge their payment method accordingly.
7.8 If a payment method expires or is declined, the Company may attempt to process the payment again or suspend access to the services until payment is successfully received.
7.9 Refunds will not be provided for partial or unused subscription periods following an automatic renewal. It is the user's responsibility to cancel the subscription before the renewal date to avoid further charges.
8. Learning Plans and Program Structure
8.1 beGalileo offers learning services through two primary models:
(a) Upfront Learning Plans where a fixed number of classes are purchased for a defined duration.
(b) Subscription Plans where access to services is provided on a recurring billing basis through the website or third-party platforms such as Apple App Store or Google Play Store.
8.2 Upfront plans are structured around two (2) classes per week unless otherwise specified.
8.3 The number of classes included in each plan is defined at the time of purchase and may include plans such as:
- 24 classes (3-month plan)
- 48 classes (6-month plan)
- 80 classes (10-month plan)
- 96 classes (12-month plan)
8.4 The Company may introduce new plans, modify class structures, or discontinue plans at its sole discretion.
9. Program Duration and Validity
9.1 Each upfront learning plan includes:
- an original program duration, and
- an extension buffer period.
9.2 The extension buffer is provided to accommodate reasonable interruptions including holidays, travel, school exams, and unforeseen circumstances.
9.3 Typical validity periods may include:

9.4 Validity begins from the date of purchase unless otherwise specified.
9.5 All classes must be completed within the total validity period. Any unused classes after this period will automatically expire.
9.6 Classes that expire after the validity period:
- cannot be refunded
- cannot be transferred
- cannot be converted into credits
- cannot be extended except in exceptional circumstances determined solely by the Company.
9.7 Extensions beyond the stated validity may be granted only in cases of documented medical or technical issues and remain entirely at the discretion of the Company.
10. Class Scheduling and Attendance
10.1 Classes are typically scheduled at two (2) classes per week based on mutually agreed time slots.
10.2 Maintaining a consistent schedule supports better learning outcomes and teacher availability.
10.3 Parents may request schedule changes subject to tutor availability and operational feasibility.
10.4 The Company reserves the right to adjust class schedules where necessary due to operational requirements.
11. Class Cancellation Policy
11.1 Classes may be cancelled through the beGalileo mobile application or through official customer support channels including WhatsApp.
11.2 Cancellation requests must be made at least two (2) hours before the scheduled class time.
11.3 If cancellation occurs within two (2) hours of the class start time or the student does not attend the class:
- 0.5 class may be deducted.
11.4 If the student does not join within ten (10) minutes of the scheduled start time, the class may be treated as a no-show.
11.5 Repeated late cancellations or no-shows may lead to scheduling restrictions at the Company's discretion.
12. Teacher Allocation and Tutor Change Policy
12.1 Tutors are assigned based on:
- student learning requirements
- tutor availability
- preferred class timings
- academic continuity
- operational requirements
12.2 While the Company strives to maintain continuity with the same tutor, tutor changes may occur due to circumstances including but not limited to:
- unavailability of preferred time slots
- request for tutor change by parent or student
- discontinuation of services by a tutor
- tutor leave or tutor pause
- operational or scheduling adjustments by the Company.
12.3 In such situations the Company will attempt to assign another qualified tutor.
12.4 Continuation with a specific tutor cannot be guaranteed.
12.5 Tutor changes shall not be considered grounds for cancellation, compensation, or refund.
13. Refund Policy for Upfront Plans
13.1 Refund requests must be submitted within six (6) months from the purchase date.
13.2 Refund eligibility applies only during the original program duration of the purchased plan.
13.3 The extension validity period is not eligible for refunds.
13.4 Refunds will be calculated on a pro-rated basis for eligible unused classes, subject to the conditions set out below.
13.5 Refund requests submitted after the six-month window cannot be processed.
14. Classes Not Eligible for Refund
The following classes are not eligible for refund calculations:
- complimentary classes
- bonus classes
- promotional classes
- referral classes
- goodwill classes
- replacement classes granted by the Company
- any free or additional classes provided as part of promotional campaigns.
These classes hold no monetary value for refund purposes.
15. Discounts and Promotional Offers
15.1 In the event of a refund request, the value of classes already attended will be calculated at the standard per-class rate applicable to the program.
15.2 Any discounts, promotional offers, coupons, or special pricing applied at the time of purchase will not be considered while calculating the value of classes already utilized.
15.3 Refunds will therefore be calculated as:
Refund Amount = Total Amount Paid − Value of Classes Attended − Applicable Processing Charges
16. Minimum Usage Condition
16.1 Refund requests must be submitted before completion of fifty percent (50%) of the paid classes in the purchased program.
16.2 Once more than 50% of the paid classes have been completed, the program will be considered substantially utilized and refunds will not be processed.
16.3 Complimentary, referral, or promotional classes are excluded from this calculation.
17. Refund Processing
17.1 Approved refunds will be processed to the original mode of payment within thirty (30) days of approval.
17.2 Processing time may vary depending on banks, payment gateways, or third-party payment processors.
18. Payment Gateway Charges
18.1 Any transaction fees, gateway charges, bank charges, or processing fees incurred during the original payment may be deducted from the refund amount.
18.2 The Company shall not be responsible for any additional charges levied by banks or payment service providers.
19. Right to Deny Refund
The Company reserves the right to deny refund requests in cases including but not limited to:
- misuse of services
- fraudulent activity
- violation of these Terms
- attempts to claim refunds for complimentary or promotional classes
- abnormal or unfair usage patterns.
20. Non-Attendance
20.1 The Company shall not be liable for refunds if the student does not attend the allotted classes within the stipulated program duration and does not submit a refund request within the applicable refund period.
20.2 Any unused classes after the original program duration are not eligible for refund.
20.3 Any unused classes after the total validity period will automatically lapse.
21. Technical Requirements
21.1 Students must ensure access to:
- a stable internet connection
- a suitable device such as a laptop, desktop, or tablet
- functional audio and video equipment.
21.2 Classes disrupted due to technical issues on the student's side may not qualify for compensation or rescheduling.
21.3 If technical issues arise on the Company's side, reasonable efforts will be made to reschedule the affected class.
22. Limitation of Liability
22.1 The Company provides the Website and services 'as is' without warranties of any kind.
22.2 The Company’s total liability is limited to the paid subscription price, pro-rated to the amount of time remaining on the subscription.
23. Indemnification
23.1 You agree to indemnify and hold CarveNiche Technologies Private Limited harmless from any claims, liabilities, or expenses arising from :
- Your violation of these Terms.
- Unauthorized use of the Website.
- Misrepresentation or misuse of the Company’s services.
24. Termination Clause
24.1 The Company reserves the right to suspend or terminate your account for :
- Violations of these Terms.
- Any misuse of the Website.
- Non-payment of fees.
24.2 Upon termination, your right to access the Website and services ceases immediately.
25. Governing Law & Dispute Resolution
25.1 These Terms of Use are published in compliance with and governed by the laws of India, including but not limited to:
- The Indian Contract Act, 1872.
- The Information Technology Act, 2000 ("IT Act")
- The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 ("SPI Rules")
- The Information Technology (Intermediaries Guidelines) Rules, 2011 ("IG Rules")
- The Consumer Protection Act, 2019.
25.2 These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
25.3 In the event of a dispute, the parties shall attempt to resolve it amicably. If unresolved, the dispute shall be referred to arbitration, governed by the Arbitration and Conciliation Act, 1996, with the arbitration proceedings conducted in Bangalore, India.
25.4 The Company shall not be liable for any claims, losses, damages, or liabilities resulting from fraudulent, illegal, or unauthorized actions of employees or third parties in the performance of services.
25.5 The rights granted under these Terms are cumulative and in addition to any rights available under Indian law.
